TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Mirror Moment Coaching Program, including any content, functionality, and services offered through kennedyeffect.com (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. ACCEPTANCE OF TERMS

By accessing our website, enrolling in our programs, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

2. DESCRIPTION OF SERVICE

The Mirror Moment 4-Week Coaching Experience ("Program") is a coaching service that includes one-on-one coaching sessions, group coaching sessions, training modules, and access to an online community. The specific components of the Program are described on our enrollment page.

3. ELIGIBILITY

You must be at least 18 years of age to access our Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old.

4. PROGRAM FEES AND PAYMENT

4.1 The fees for the Program are as stated on the enrollment page at the time of purchase.

4.2 All payments are processed through secure third-party payment processors. We do not store your complete credit card information on our servers.

4.3 You agree to provide current, complete, and accurate payment information. You authorize us to charge the payment method you provide for the Program fees.

5. REFUND POLICY

5.1 We offer a 5-day satisfaction guarantee. If you participate in the program for 5 days (including your first 1:1 session) and don't feel it's the right fit, email support@kennedyeffect.com for a full refund.

5.2 After the initial 5-day period, no refunds will be issued for any reason.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Kennedy Effect LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

  • If we provide social media features with certain content, you may take such actions as are enabled by such features.

7. USER CONTRIBUTIONS

7.1 The Service may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials to other users of the Service.

7.2 By providing any User Contribution to the Service, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

7.3 You represent and warrant that all of your User Contributions comply with these Terms.

8. PROHIBITED USES

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

8.1 In any way that violates any applicable federal, state, local, or international law or regulation.

8.2 To transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

8.3 To impersonate or attempt to impersonate Kennedy Effect LLC, a Kennedy Effect LLC employee, another user, or any other person or entity.

8.4 To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Kennedy Effect LLC or users of the Service or expose them to liability.

9. DISCLAIMER OF WARRANTIES

9.1 YOUR USE OF THE SERVICE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE IS AT YOUR OWN RISK. THE SERVICE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 KENNEDY EFFECT LLC IS NOT A LICENSED MENTAL HEALTH SERVICE PROVIDER AND THE SERVICE IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN, MENTAL HEALTH PROVIDER, OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL OR MENTAL HEALTH CONDITION.

10. LIMITATION OF LIABILITY

IN NO EVENT WILL KENNEDY EFFECT LLC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Kennedy Effect LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. GOVERNING LAW AND JURISDICTION

All matters relating to the Service and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the State of [YOUR STATE] without giving effect to any choice or conflict of law provision or rule.

13. DISPUTE RESOLUTION

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of [YOUR STATE], although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

14. WAIVER AND SEVERABILITY

No waiver by Kennedy Effect LLC of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Kennedy Effect LLC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

15. ENTIRE AGREEMENT

The Terms constitute the sole and entire agreement between you and Kennedy Effect LLC regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

16. CHANGES TO TERMS OF SERVICE

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
